I'm not sure if you've read the articles on the Cooper vs IBM pension
lawsuit settlement. (see coopersettlement.com/subclass1and2)
It seems we might have won. I say 'might' because
the terms allow IBM to appeal certain portions of the settlement while
also setting a cap on damages should they lose the appeal.
I'm about to file an objection, pro se, to the settlement. The part I
want to object is the awarding of attorney fees to be paid from the
settlement. My feeling is that IBM should pay the fees and the
plaintiffs should be made whole from the final settlement.
The judgment is based on age discrimination and violation of ERISA law.
Have you ever heard of a class action where the court would award
attorney fees to be paid by the defendant rather than from the
plaintiff's award? I have until July 11, 2005 to file an objection.
Thanks for any feedback you can give me. I'm going to file an objection
even if I have no legal references or precedents. There's little enough money to go around as it is.
