obtaining the pictures?

What is the name of your state?ohio this has to do with child custody also. My ex and i where involved on a fight on 11/20/04 at that time we seperated. We both were charged with dv. She plead quilty at the arraignment, while I at first plead innocent, then at pretrial plead guilty, due to my mother telling me to. Now, our sentencing is 2/10/05. She has told me that the probation office told her that she will be able to have this erased from her record.She was the aggressor in the inncident. Now i have asked the police for the pics that were taken at the police station. They called the DA and i was told i can not get the pics till after the sentencing. We are going through a custody battle, and the only thing that could effect me from getting custody of our son is this dv. Is it legal for them to hold the pics? I am afraid since i am a male that the judge will sentence me differently then her, in both cases. She out weighs me by 100lbs. And i was the one that was beat up, though i did strike her once then immediatly went to the police station and turned myself in. Will the judge in our custody hearing look at the pics? Court is in a few days what do i do?

Court in a few days, you face domestic violence charges and face losing custody of the children and you ask What should you do?

How about getting an attorney who can subpoena the photos? It's not rocket science. :rolleyes:

let me explain a little more. I can not afford an attorney, but may i request the pics? How do i go about it? Secondly, i was never married and in the state of Ohio as of 1998 a unmarried mother has residental custody/sole custody until court ordered. I have filed on my own and awaiting mediation. The mother, allows me to have shared parenting, me having our son three days one week, and four the next. I dont want aNYTHING TO GET IN THE WAY OF THE CUSTODY DISPUTE AS I am seeking residental custody of our son, not sole custody. How do i get the pics? With them i can prove that i was the one assaulted and acted uin self defense. The dv isnt my biggest concern, some form of custody is. please respond . Again i cannot afford an attorney. I dont have 750, 1000 to give for an attorney.
