Hello,
If you need a refresh, my 3 previous posts should cover everything I guess.
So we realize that this foreign judgment is at our front door, and we are taking steps to try and work this out.
Probably will be seeing an attorney tommorrow, whether or not that will do any good I don't know at this point.
So my question is:
Even though this major university and their lawyers have a judgment against my wife, if we offer some sort of payment plan, do you, in your opinion, think that they will be reasonable and accept it? We'd rather try it this way that file chapter13 because my wife has no income. I guess to re-word this, is it WORTH going to pay an attorney at this point to try and help us out, or has it gone to far, being a court ordered judgment? I'd hate to hand the guy a bill or three, and deep down inside he knows that we're up schit creek without a paddle, but pretends to jumble around a wad a paperwork.
After getting the foriegn judgment paperwork, approx. how long will it take for the court to summon my wife to appear, generally? Remember, this is Ga....things are slow in this city.
Thanks again for all your help, where else can someone get some FRANK answers free of charge...last time I saw an attorney a million years ago, he sugar coated everything, made me feel better, took my money, and I still got the shaft.
Thanks

My response:

I liked it when you said:

" . . . where else can someone get some FRANK answers free of charge...last time I saw an attorney a million years ago, he sugar coated everything, made me feel better, took my money, and I still got the shaft."

Some people actually want to be coddled and be given good news and hope where none exists - - they want to be able to feel comfortable with their thumb in their mouth, and curled up in a fetal position. Sometimes the law is not a cradle of safety.

It really is a good idea to spend the money on a consultation. There may be nothing good in terms of the judgment that an attorney can do for you - - e.g., fight it.

However, having an attorney attempt to negotiate a "deal" for you may make the plaintiff more "receptive" than if you tried it yourself. You see, the plaintiff already has a "mind-set" of not being able to trust you or your wife.

But, with a local attorney, at least you'll have a more particularized idea of where this matter is headed and how things will "play out" due to particular laws and procedures in your neck of the woods. Also, if the worst does happen, at least you'll have somebody local to you who can guide you in the final points along the way.

Good luck to you, and please, stop calling me "Frank."
