I work for my apartment complex and every third week I am required to be on call. During this week, I must stay within a couple of miles or five minutes of the complex. I carry a pager the entire week and must be available as the first line of support for the people who live in the complex. I do not get paid to be on call, but I am forced to put my life on hold, incase something happens. And when r if it does, I do not get paid for that service I perform.
The one exception is for lockouts. If someone is locked out after a certain time, they are required to pay me $10-$15 to let them back into their apartment. Since I started in Feb, I have had only two lockouts.
This does not seem fair to me that I am required to put my like on hold, every third week to stay close to or at home and always have the pager with me. And then to not be paid, if I do get paged.
There is also a Maintenance person on call with me, but they only get paged by me or the office, AND they get paid over-time for any work they do.
Is this legal? I feel I should be getting some type of compensation for being on call and missing events that I really want to attend, like visiting relatives on a holiday weekend.
