What are my rights if I settled a debt with someone and they came back after cashing my check and told me that I owe them more money? This was in Ohio. Dummy me, I drafted a check over the phone, so I did not get a written agreement. But the supervisor girl flat out said to me that the person who accepted the terms was not longer working there because he was accepting payments that are too low. As I said before, I really hate talking to these people, any ideas or insight??

mmmmmmmm did you get this girl's name? i personally would make the company honor her verbal agreement w/you....it was her fault, not yours , for accepting a settlement offer that was too low. A person's word should mean for something and she was acting as an official represenative of that agency... if that doesnt work play around w/the word atty or bankruptcy they might just go ahead and clear everything...OF COURSE this time get everything in writing. If that doesnt work try to work something else out where you give them a little bit more money, etcc... to clear your delinquent acct. up.....usually if a company is in the habit of allowing settlement offers the usual acceptable range would be 75%-80% of your balance due....hope this helps..

unfortunately this is more of a pride thing. they are only asking for about $25 more, but i refuse because the company that they are collecting for (ameritech paging) breeched the contract in the first place for stupid reasons. My husband's credit is already shot so one more derogatory isn't hurting it too bad. they tried to tell me that BK wouldn't cure this. But, i really do appreciate your response. Thanks!

oops forgot to say that I did get his name. I called the super and talked to her, actually she called me at work to tell me that I needed to give them more money. She wouldn't budge. I was gonna file a report with the Attorney general, but I stalled now it's been about 18 months since the settlement. I suppose they won't get their money and we won't get a paid collection. Oh well. . .live and learn.
