If the NCP is only paying support when their license is suspended, paying just the amount to get their license back, is that still considered failure to provide support by the court?

Well...they are still going to have arrearages, and will still be in contempt for not fully paying child support, but it might not quite rise to the level of "failure to provide". In many states "failure to provide" is a quasi criminal charge and a bump up in the overall contempt of court situation.

You would really need a local attorney to answer that question. Many people here could give opinions on the issue, but the specific answer is going to be based on your state's statutes, and the climate of your local courts.

thank you for answering. There has already been a contempt of court on her and now a Writ of Body Attachment Issued; which I am confused about. She paid the CS (late) when they suspended her license, but did not pay the lump sum from the contempt of court.

It just looks very confusing to me.

It generally is confusing...because generally there is no guaranteed result.

Would there by any downfall, beside having to file for enforcement on my own, if I move the case out of the Office of Child Support to a civil case? Quite frankly, the stress of what may happen every 6 months when they go after her for enforcement, isn't worth the 120 bucks they collect.

Or should I just leave it? She still has a plethora of other problems.... it hasn't changed.... she has repeated her same criminal behavior again in the past 6 months.

i'm wondering if the CP's protest of releasing the license until the full purge amount is paid would matter.....
