Hello!

I am starting a small game development company in North Carolina. Right now I am going through the process of creating an LLC. However, I have some questions regarding employment:

We have around 30 people working with us right now. I would like to pay off 20 of them and have 10 remaining for maintenance and upkeep. I have a few questions regarding this:

1) Am I able to contract with them in such a way that they may be paid an amount to be determined once their work is completed (with a minimum and maximum value) based on the hours they contributed?
2) Some live in different states, do I need to mail them the contract and then have it mailed back?
3) Can I write this on my own with some guidance from examples, or must a lawyer write it? Do their need to be witnesses?
4) A few employees are under 16, though within legal working age in their state. Do I just need their parent to sign on as well, and then its valid?

Or would it be better to just have them act as volunteers and write up a contract for them to sign over all their work to my LLC? And then not actually hire them, but still take their work and then pay them as some sort of compensation?

I'm a Northern Girl
You need much more than a message board. You need a lawyer. You absolutely canNOT pay employees the way you describe in (1) and you absolutely canNOT have employees work as volunteers. You *may* be able to manage independent contractors in that way, but whether you can legally treat them as IC's is in doubt and is really beyond the scope of a message board.
