ongoing case against daughter

I have a 8 going on 9 daughter. She is not happy alot of time with dad. He lives at a great place for her locally...2 ponies, cats, a dog,...he is a caretaker.

History, since daughter one year old have been taken to court consistantly for custody and chld support orders. Over 25 times. A custody evaluation, which took ex two years to settle on, a trial, many court appearances before and after. Child does not want so much time with dad...close to 50/50. I am not alienating her although dad has accused me of this (and other horrid things) from the beginning. Courts do not listen...our legislation is as much time with both parents as possible. Period. Yet our custody evaluation, updated TWICE is very clear that child should have primary residence with me. That got completely ignored the last time iwe went to court in 2006...she got moved to move towards 50/50...no mention of the custody evaluations...that court date I went prose. Its been over one year and daughter has suffered ever since. Her animostity, her love/hate relationship with dad, called "ambivalence" has struck up...I am stuck between the evaluation and the court ideals...the evaluation being she is best with me as primary parent and he sees not evidence of dads claims of badmouthing dad or alienating him...to the courts needs for 50/50. I lost that round...she got more time with dad - in my opinion more time WITH dad given the school days he has her are her short days at school...I have all her long days with the home cooked lunches...no time for play afterwards.

In the meantime school teacher says she needs playdates with outside kids (alot going on at school) and I told dad at meeting "this is up to you to do" but he is not doing. Child is having problems at school, suspended twice after bad experiences at dads...but nobody really wants to hear about that. So in many ways I consider he has more quality time with her than I do given the short and long days at school.

Bottom line, daughter has had issues, major, with her dad for years. Its a love hate relationship and has sabatoged my ability to raise her with good ethics...be kind of others...as she hates her dad.

How can I present this to court...that the cust eval analysis of love/hate has not stopped and is inhibiting daughters ability to grow up healthy and loving.What is the name of your state?

I think that I may know who you are, from another forum.

If I am correct, your daughter is in counseling. If so, then the counselor is the best person, via testimony in court, to present this information to the court.

If I am wrong, and your daughter is not in counseling, then getting her in counseling is the best first move.
