What is the name of your state (only U.S. law)? fl I posted last week about my experience in court, I will try to save you the whole drivel and give you the short version. I sent a Summons, Motion for Contempt and had it served on x hubby in state of Ohio. The hearing was last Tuesday, NCP, x hubby, never showed up and never filed an answer. Even the Summons warns him that failure to show can result a WRIT of bodily attachment for whatever the hearing officer did very little, she said she would write an Order to appear and I would need to have it served on NCP and she schedule a hearing for Nov. She told me she would have it done last week, in fact she mentioned having it done that day, but said judge would have to sign it, but nonetheless I should have it by the end of the week (end of last week).
I called, got her assistant she was suppose to call me back, never did, I called two days later, left message. Typically how long does something like this take? Funny thing is I asked her while in court I say so about two weeks then, she says oh no, I will type it up today or tomorrow and you should have it by the end of the week! Its been one frustration after another. I realize she wants my x in front of her to answer these claims and all but good grief, its sure seems like a do over to me.
I will say that the state of Ohio, once they found my paperwork from the state of FLorida, has been been very helpful. They misplaced my paperwork, twice, for over two and half months, despite me calling and raising a ruckus, telling them that they had to have me somewhere in their files because they sent me paperwork, so they had my address and name somewhere! Anyhow, how refreshing to be able to call the county CSE and actually be able to speak with your caseworker, how nice to have a caseworker. You don't have that here in Florida, if you call and ask a question it takes nothing less than 30 days to get an answer, how utterly sad and inexcusable.
Its no wonder we have so many deadbeat NCP's in my state, the state enables them to do so.
The caseworker in Ohio told me that if Florida does have my x picked up on a warrant Ohio would stop enforcing the case, I assume that is because florida would have him in their custody, does anyone have any knowledge regarding this?
