I bought a 2 family home with my then mother-in-law in 2/96 - I am now divorced and am renting my apartment. I would like to know what are my options on getting out of the mortgage? The mortgage and deed is in both our names - I am the primary source.

I know we can sell the house but in the case that she does not want to sell can I force her to sell or can I try to buy her out forcibly?

Thanks.

Can you please explain what the partition form entails? and approximately how long the process is?

Thanks.

Sorry. Every State is different with different court procedures, filing forms and court calendars. I have seen cases take from 6 months to 4 years.
