I Got Dui In Oregon Recently And I Have A Prior In California 3 Years Ago. Wll The Dui Be Consider A First Offense In Oregon.

Depends upon if Oregon has access to your CA driving record, or if CA shared that information.

I would suspect it would be counted as a first.

Gee, no one ever thought of that one before, "If I just keep moving, they'll never figure out that it's me, and that I'm doing the same thing, yet expecting different results."

Even though each DMV is state run, THEY DO COMMUNICATE with each other. Seeming as a DUI stays on your record for 7 years in CA (or is it 10 yrs now?) the information probably has gotten to Oregons DMV and therefore also to the court system. Because you've been charged with DUI gives them an even better reason to do a thorough background check.

Is it really that hard to keep from driving after you've been drinking?

The DMV record of the DUI is irrelevant here ... the key is whether Oregon state law permits out-of-state DUI convictions to be considered for subsequent DUI enhancements in Oregon.

I don't have the answer to that question, but an attorney in OR sure would.
