This is a very, very sad story, but I thought this would be interesting reading, especially for the lawyers on here. Here is the link to a story about a child here in Ohio who died because their foster parents decided to go on vacation -- BUT LEAVE THE CHILD TIED UP WITH PACKING TAPE -- AND IN A CLOSET.

Now, the birth mother is suing the foster parents and the Ohio Department of Job and Family Services -- for 5 MILLION BUCKS!!!.

Thoughts...over the odds of the birth mother being able to win anything. I have not been able to find (as of posting) whether this woman was stripped of her parental rights.

I have looked at this myself and do not see where her parental rights to her children (note that all of her children were taken) were terminated. If her rights were actually terminated then I would argue that she doesn't even have standing to sue. The other thing is that social services does enjoy some immunity depending on the specific facts surrounding the child's placement. I was personally disgusted with the lawsuit because it is obvious that biomom is nothing more than scum seeking to capitolize on her lack of responsibility. Hopefully she won't get past the motion to dismiss:(

Actually I am listening to her attorney talking right now...there's alot that wasn't in the article. I believe she DOES have a case...she asked the County Children Services for assistance because of mental, parenting and financial deficiencies...the attorney is still talking. She asked for assistance for herself and the children because she was unable to control them. Plus there are brothers and sisters, too. I haven't heard anything about the dad here. I see it as a matter of holding these agencies responsible for placing children in the care of idiots. Just a few months ago, there was a case of caged kids (that made national news) that were placed by the Ohio Dept of Job and Family Services.

This will be interesting. CNN reported yesterday that the children were removed for neglect. Of course as we learned in the last two weeks with that Karr character, the media is soooo accurate. On the other hand, if I'm her attorney I would say exactly what he is saying....so we wait for what the evidence reveals.

This is sickening- but no more sickening than when I hear about bio parents doing atrocious things.

The problem here...IMO (Yes, I realize no one is lining up for it!:p )...is that this Mom couldn't take care of her own children. But had multiple children. :rolleyes: And, as a parent I think it's 'odd' that you first turn your children over because you can't handle it~ Then complain when someone abuses/hurts them, as obviously the Foster Parents couldn't handle it either. :cool:

The foster care system across this country is in shambles as far as I am concerned. I think that this case is a good thing. I think its time that people be held accountable.

Someone capable of doing what they did should not have even been able to qualify as foster parents.

I agree, regardless of mom's motivations for bringing the suit- the suit will bring attention to the state of the foster care system, and the manner in which people are qualified to provide foster care...which in the end will be a good thing for the children who need to be placed in foster care- for that reason alone I hope mom wins her case-then everyone will make sure their I's are dottd and their T's are crossed

After reviewing the Associated Press' most recent article, it would appear that there is also a private placement agency involved. More likely than not the private agency does not have discretionary function immunity so guess whose insurance company gets to defend this action and foot the bill?

That may be true, but what qualifications do bio parents have to have?? :rolleyes: I've heard of parents doing horrible things to their children MUCH MORE often than I've ever heard of Foster Parents doing it. In fact, Foster Parents are at least required to go through SOME type of training, preparation and monitoring.

I just think it's convenient that Mom has a $5 million price-tage on her child that SHE gave up because SHE couldn't care for the child herself. If she were a competent parent...none of this would ever have happened. In fact, if parents took better care of their children overall~ The Foster Care system wouldn't be so overwhelmed & overloaded.

Again, my 2c. Take or Toss.;)

But they'll have $5 million less in resources to do it with. :cool:

Its simply worse in my opinion when its a foster parent. The are someone the system CHOSE to care for the children because they had needs that could not be provided by their parents.

Obviously we don't want to get the to point where "big brother" controls our reproductive freedom....however foster parents are selected. The system needs to do a better job of selection.

Agreed. However, I don't see why we can't hold ALL parents (by birth or choice) to the same standards.

And, yes, I realize I feel the good parts of the system need to be defended...because you only hear about the things that go wrong~ And seldom hear ALL the times it works (No News is Good News kind of thing). ie; On the SAME page as the article posted is the story of a an 8 mo. old baby in the hospital for head trauma/fracture in their own home. :(

And who POLICES idiot bioparents that take home kids with nobody checking them out? I agree. No children should be placed in the care of irresponsible caregivers, be they bioparents, foster parents, or adoptive parents!

Just my warped attempt at humor(sort of)

I have been of the belief, for a long time, that there should be some sort of evaluation done when a person reaches puberty. Those who *pass* may procreate...those who do not may not...I believe stupid peoble should not breed.
