What is the name of your state? I am from Michigan. I was the manager at a retail store and for 2 years I have been doing overtime ( students not showing up for shifts, so I covered, etc.). The owner refused to pay me. I quit so I went to the DOL. They agreed that the owner does owe me money. They called him to pay me and he said no, it was not authorized! The DOL called me and sent me a letter and they told me that they could not force him to pay, but I could pursuit it legally in a civil court. What are my chances of winning? I have kept ALL my paystubs. Please let me know...Thanks :)

At this point, you need to consult with a local attorney. If the DOL agrees that you should have been paid OT, I'd imagine your chances of prevailing are quite good. I'm very surprised that the DOL has said a violation of wage and hour laws occurred and then tossed you to the curb.

You need to speak with an employment law attorney.
