Overpayed & Still Withholding

Am I entitled to interest on MY money that is being withheld by the D.A.'s office even though support payments have been met in their entireity and paid in full?

Approximately a month ago I received notice in regards to this along with an audit of payments along with a refund check for overpayment. I also received from my current employer a Notice of Termination of Withholding. At that time I called the child support agency and informed them that I changed employers and inquired as to their being notified. I was assured everyone had been notified that needed to be.

APPARENTLY NOT! Two weeks later I received my pay stub and it had been garnished for 25% of my earnings. I waited patiently for a week thinking that my money would be returned. Finally I called and asked where my money was at. My last support payment was made on 8/6 and on 8/21 is when they helped themselves. It is now 9/9 and I'm told that I have to wait 20 days and then if I still don't receive a refund check then another one will be issued but in the meantime I should talk to my post office. I was then asked, "Are you sure that we have your correct address?' (A month ago they did!)

This is what brings me to my question- Am I entitled to collect interest on my money that is being failed to be returned to me along with their negligence in terminating my withholdings thoroughly?

I sure paid enough in interest on the money that they wanted from me. Am I entitled to the same?

This would be petty !! Wait the time they have told you to.Appearantly they sent the mistaken withholding amount back to you . It hasn't arrived. Wait the 20 days , then do as you're told .

I would caution you though , if you end up with both checks, only cash one, and send the other back ( with proof ).

I'd just like to know though,what percent interest did they charge you ?

And why. Interest isn't usually charged unless there's an arrearage......

Exactly !! I was just wondering . It had nothing to do with what the poster has been advised to do.

Arrearages are what you receive when the D.A. decides to wait for three years before contacting you regarding a dead beat dad who owes you over $50,000.00 in back support but gets on welfare. And when you have three years of back support alotted to you in a days time yeah there's arrearages. I paid more in interest than I did actual support. Now who's petty?

Maybe if I had gotten on welfare I might have seen some of the support owed me.

Shame on me for allowing my son to go and live with his dad!

ARREARAGE: the state of being behind in the paying of debts; unpaid and overdue debts.

Isn't this what the D.A. has done with my money?
