Overtime curiosity

What is the name of your state (only U.S. law)? FL

I'm not certain this is illegal but I was curious enough to run it by you guys. My niece works for a local grocery store. She is a standard full time employee working 40hrs per week. During holidays there are times where she works sometimes as many as 52 hrs. The part that has me bothered is that on days she ends up with overtime, she is then told she is required to go home early the next day in order to remove it and is then subject to disciplinary action if she does not remove all overtime by the end of the weekly pay period. This more than often leaves strain on the other employees in her department as there are days when she must leave early during very busy times as she has overtime hrs from the previous day to remove. I do understand that all hours worked over the standard 40 hrs must be paid time and a half but is it legal to force the employee to leave work early to remove said overtime?

Perfectly legal. My neighbor works for one of the big boxes and this is EXACTLY how they handle overtime. They are scheduled for 39 hours deliberately because they know they'll hit the 40 with customers
. The employees are subject to discipline if they go over without manager approval for overtime.

Perfectly legal. No law requires an employer to allow an employee to work overtime. If they want to send her home to avoid having her work more than 40 hours that week, they may.

Yep.

Yeah I figured it wasn't illegal but told her I'd ask the crowd anyway. :cool:. Also said to look at it this way, she works extra hard one day to get a nice short work day the next. Its like getting an extra day off (ya know, optimism n all) Thanks much guys!
