What is the name of your state? California

What are the situations when a part time employee in California is eligible for overtime.

Over the 8 hours in a workday or over 40 hours in a workweek, but these are part time employees. Occasionally over 8 hours in a workday, but rarely 40 hours in a workweek.

Do we have to pay overtime for a partime employee that has 35.75 hours in a 8 day period, since it is the 7th day rule. Employee was worked 8 days straight, but never on overtime during those days, nor over 40 hours in the workweek. Just the 7th day of work.

Thanks

And now you know why most states don't accrue overtime on a daily basis.
