overtime pay??

I am an account manager for a finance company and my employer considers me non-exempt. Does my employer have to pay overtime for hours worked over 40?

If your position does not qualify for exempt status, yes, you must be paid time and a-half for all hours actually worked over 40 in each 7-day payroll period.

Even if your position does qualify for exempt status, if they are paying you on a non-exempt basis (i.e. only for time actually worked), then they have to pay you OT.

However, if you worked the excessive hours without authorization, they can discipline you in any other way they see fit up to and including termination. The only restriction on them is that they cannot refuse to pay for unauthorized time.

one more question...

Thank you so much... one more question...I am paid by salary and I am non- exempt, does that still quailfy me for overtime pay?

If you are non-exempt, it is legal to pay you on salary AS LONG AS you receive OT when it is worked.

As I understand it, and compensation is NOT my strongest area, there are some circumstances in which a salaried non-exempt employee does not have to receive OT AT TIME AND A HALF, but they still have to receive the OT.
