I work as a home health aide. In the past two months i have been getting over 80 hours in a payperiod. The hourly rate is divided i get $8.06 from 6am-5pm and after 5pm I get $8.56. My employer says because they split day and evening pay I don't qualify for overtime. This seems unfair because I'm averaging over 105 hours in a pay period. Can my employer do this? Or do they owe me for all my overtime?

My opinion is that they probably owe you for at least some of the back overtime. But health care workers sometimes fall under slightly different OT laws, so it may not be as much as you think. It would depend on how the hours fell over the pay period.

By all means, contact your state department of labor.
