Owe Rrent - Trying to Pay - No communication

Hello!

I owe my landlord $245.00. He claims that I owe him "at least" $320.00. I verified that I owed the rent of $245.00 through bank statements and the money order for the month of May. I sent him an email stating that I would send $50.00 until paid in full. I then sent him a check for $100.00 on August 22, 2011 with a letter stating that I would pay $100.00 immediately (with the check enclosed) and the remaining $145.00 on September 16. He has yet to cash the check and he has yet to respond to any emails being sent to him. I like to send emails as that is our primary form of communication.

What can I do? Would this show good faith to a judge to prove that I've been attempting to pay the debt owed?

Has your landlord initiated legal action (i.e., begun the process of eviction) because of this owed rent?

If so, in many states accepting rent (even portions of rent) will stop the eviction process.

Landlord doesn't have to accept your repayment terms. Okay, so you sent emails, but that doesn't mean he received, read or agrees to what you propose. Do you have any emails from landlord agreeing to accept your terms and not to begin eviction procedures?

**A: there may be more issues than just what you posted and the landlord just wants you out.

Agree w/HG . . .something seems to be missing here. Also, forget about "good faith" - faith, intentions and efforts don't pay the bills.

Thank you for your responses. Let me give more information.

The primary form of communication the Landlord and I have is email. Every time I call he is not home. I was late in the month of May yet he didn't tell me anything until August. I did attempt to email him in June and twice in August. He responded only to my repair request, but when I ask him ANYTHING about the owed rent, he never responds back. He did tell me that he wanted it by the end of the month and if I can't do that, then let him know. I've let him know that BUT he didn't even respond to that.

The landlord hasn't begun any eviction process. The landlord has never said that he wants me out, but I requested the good faith effort just in case it gets that far.

My main issue here is that it is impossible to communicate with him. I can't call him, and he hasn't responded to ANY emails.

Once again, thank you all for your responses.

Hmm. Oh well, apparently he doesn't like to talk about past due rent and is willing to go along with you paying what you can when you can. Consider yourself lucky. No one can make him communicate with you.

LL does not have to accept the money you sent him. If he did than he would be agreeing that you only owe that amount instead of the $320 he says you owe.
Showing him your bank statements does not mean you paid him rent.

Tha'ts because he knows it is hopeless and he is done with you. Why? 1) You set your own amount due 2) You sent payments but not enough 3) He has told you to pay at a certain time, and you have not

He will if you don't pay ALL THE MONEY that LL says is due and not you.

If this really is a concern to you, send LL a crr letter and than you will get a response. You think that by emailing him proves that you tried but he doesn't.

The original payments were made by money order. I have a copy that he cashed the money order. He is claiming 320 without any proof that I owe 320. I DO indeed owe 245.00 the money order can prove that. I did send him a certified letter and he cashed the check that I sent him. I also sent my rent payment with the certified letter, that has yet to be cashed.
