I got a speeding ticket on 11/27 in Pennsylvania. Officer clocked me going 92 in a 55 using VASCAR. He wrote me up for "60+" and made a note that I "was cooperative" and also noted "no points".

Now, I was going to just plead guilty and pay the fine since I was going over the speed limit, but I noticed that the last calibration date for the electronic timing device (VASCAR) that he used was 8/30. The Pennsylvania statute that I could find online seems to indicate that any electronic timing device needs to calibrated every 60 days. Now I think he only gave me 5 over since I would be less likely to fight it.

If I plead guilty is it possible that I could get points since the comments on the ticket say 92.2 MPH, even though he wrote 60+ and no points? If I get the calibration records for the VASCAR and it really is out of date, can I go to court and have the ticket thrown out just on that alone? Does going to court open myself up to getting points?

His visual estimation that you were exceeding 60mph is enough to convict. I'm amazed that you are really looking this gift horse in the mouth...

Do you really think he cares one way or another whether you fight the ticket or not? Maybe you think police officers work on commission?

The 5 over would have to be based on visual estimation anyhow. That same reg you are looking at says that electronic means can't be used for less than 6 miles over the limit.
