paid incorrectly-timing of correction?

What is the name of your state (only U.S. law)? NJ

Exempt employee. Paid bi-monthly. Came off of temp disability. Resumed FT hours March 1. Discovered my pay check was incorrect. Advised manager on 15th. Told correction would be processed next pay period on May 1. (We are paid 16th and 1st). Employer refused to have separate check cut. When I mentioned the tax implications I was told I would get it back when I filed taxes next year. At COB today my boss sent me an email saying my pay would be adjusted on the 16th.

Are there any standard timelines for an error to be corrected? A month seems a bit much. Between this, additional tasks assigned on top of a fairly heavy workload- one of which I truly am uncomfortable with the thought of performing- and the recent change to health insurance that they didn't bother to advise me of, I'm starting to think they would love for me to take a walk.

I hope you mean semi-monthly (twice a month) instead of bi-monthly (once every two months).

Federal law has no statutes that require corrections to be made in any given time period, and neither does any state that I am aware of. I have not studied your state specifically. You can certainly call the state DOL and ask, but I have never heard of a state law, and there is no Federal law, requiring an employer to cut a separate check for corrections.

Yes that is what I meant! Thanks. I accepted tbey wouldn't cut a separate check. I'm upset that the correction being processed now has to wait another 2 wks, in addition to the original 2 weeks i was told. I've no idea how I'm going to be able to afford food after paying my rent. Everybody had their struggles.

It's entirely possible your payroll department has an established cutoff over a week before the pay date. Your boss may have simply failed to notify them of the error in enough time for them to correct on May 1. Having worked in payroll for many years, I can tell that most payroll people would much rather correct an error sooner rather than later otherwise they are the ones that have to deal with a pissed off employee.

Do you complete a timesheet?

Sorry, I just saw your question. No, I'm a salaried employee. We sat in her office on April 15th and went over the error, she was updating her spreadsheet that she submits and said it was merely a typo. I was advised it would be corrected for the May 1 payroll with back payment. Not only was I advised that I wouldn't receive the back payment until May 16th payroll, I was also advised that the payment would be shorted again. To me it was pretty clear that although we had gone through the numbers and she had updated her spreadsheet that she hadn't forwarded it to ADP timely.
