in the state of pennsylvania when does a parent loose parental rights.my sons father has made no contact since my was 10 months old, my son now is 9 years old. my husband wants to adopt him. can he adopt without the consent of the biological father?

I WENT THROUGH THE SAME THING WITH MY EX HUSBAND HIS FORMER GIRLFRIEND GOT MARRIED AND WANTED HER HUSBAND TO ADOPT BOTH OF HIS CHILDREN.WELL SHE BROUGHT HIM TO COURT MIND YOU HE HAD NOT SEEN THE CHILDREN IN I BELEIVE 4 YRS AND THE JUDGE TOOK HIS RIGHT TO SAY ANYTHING AWAY AND THE ADOTION WENT THROUGH.I HOPE THIS HELPS YOU.

It gets complicated, so you should get an atty.

If the father hasn't had contact in over a year, it is called abandonment. It takes a little longer, you will have to publish the adoption, to see if he comes forward, to dispute the adoption. If he doesn't it will go through with no problem.

If he does try to stop the adoption, take him to court for back child support. Tell him you will drop it if he signs the papers.

My Mom did this to adopt my nephew, and I am getting ready to start the same thing. Both in PA. You will also be issued a new birth certificate.
