Parental Rights Removal

What is the name of your state? Mississippi
I want to know, what, exactly, are the laws of Mississippi in removing parental rights? The father of the child did not know the child for the first 4 1/2 yrs. of life (a problem which was beyond his control). Paternity has been established, he is the father. After the 4 1/2 yrs., he saw the child for a year, but the mother has made it very difficult. The paternal family has supported this child for the first 5 yrs. of his life and the father is now paying child support. He is now seeking visitation alone. The child is VERY bonded to the paternal family and we have paid his support for his entire life and the paternal family won the rights to visitation with the child in court. We, as the grandparents, aunts, uncles and cousins of the paternal family have all the visitation rights to the child because of the extreme bond we have formed with this child. The judge realized what a tremedous effect we have had on this child's life and ruled in our favor.

The mother is now going back to court to remove parental rights. I know this "removes" the paternal family completely. The paternal family does not want to be removed from this child's life. Can this happen if the paternal family has had a HUGE influence on the child and we are there to protest this and the father is there to protest this. I know the judge can do what he wants to do, but, I want to know what is the likelihood of this happening?What is the name of your state?What is the name of your state?

No one can predict what the outcome will be. However, the father's FAMILY has nothing to do with the matter. If there is good reason to terminate the father's rights, his family's relationship with the child is irrelevant. As a matter of fact, I wouldn't advise the father to even mention that his family has ANY influence over the child. If there is cause to terminate his rights, doing so could HURT his case. What is the mother basing her case on?

the family cant protest anything. this is your son's child, and he is the only one who can contest his rights being terminated. he and the child's mother are the ONLY ones with rights to the child.

Ok...first, the "paternal family" did not win visitation rights, the grandparents did. That's an important distinction. I doubt that all of you were named as parties on the petition, because only the grandparents would have had standing.

In most states (and I am pretty sure it applies to Mississippi) grandparent visitation orders survive a termination of parental rights or a stepparent adoption. Therefore the grandparent's visitation order should remain in effect even if mom is able to terminate dad's parental rights. Since they do have a visitation order, they should intervene in the suit as interested parties.

Also, since dad has been seeing the child, and has been paying child support himself (I hope that he has been paying it himself and can prove it) this shouldn't be a winner for mom. However, if he has NOT been seeing the child or if his family has been paying his child support for him, that may change the outcome.

Omigod! This is so terrible after all that you've done! I've read all of the posts on this, and I am wondering why mom would all of a sudden turn on you after all of this time. Did something happen? I would be just SO upset if I were you!
