My parents paid 40k cash for a house for my husband & I. The closing lawyer was supposed to do a deed to protect their investment as we were to fix the house, get a loan and pay them back. We got a loan to do the fix-up. I divorced my husband and he was supposed to finish the house but he let it go along with the loan payments (it was bought by Fairbanks Capital who did not work with him or me when I tried to catch up the payments.) To stop the foreclosure I filed for bankruptcy which listed my parents as first holders on the house because we found out there was never a deed filed for them. All the lawyer did was mail them the paid off deeds from the estate. Unfortunately the bky court didn't think the house would sell so it reverted back to the lender who sent me payment coupons for 6 months which I couldn't pay and I was trying to sell the house & had buyers when found out that house had been foreclosed in Nov. It's in a REO. I do not want my parents to lose 40k. Is there any action we can take?

Yes. You and hubby can pay back mom and dad.
