Depends on what State you are in...

In California, according to Calif Family Code section 7503;

7503.The employer of a minor shall pay the earnings of the minor to the minor until the parent or guardian entitled to the earnings gives the employer notice that the parent or guardian claims the earnings.

They live in the state of Texas.
Must the notice be a court order or written by the parent or can the parent just go to payroll department and demand check?

Sec. 3.103. Managing Earnings of Minor

Managing Earnings of Minor;

During the marriage of the parents of an unemancipated minor for whom a managing conservator has not been appointed, the earnings of the minor are subject to the joint management, control, and disposition of the parents of the minor, unless otherwise provided by agreement of the parents or by judicial order.



If you are divorced from the other parent, and are named managning conservator of the child/ minor, then you are in contorl of the minor's earning's. If you are not, you and your Spouse jointly control the minor's earnings.
