What is the name of your state (only U.S. law)? Missouri.
My brother's ex girlfriend was booked for testing positive for amphetamines when she gave birth to my brother's son. I have been made aware of the fact that the State of Missouri is now going to take her other children too. This girl was still married to another man and has now named the little boy and given him her husbands last name instead of my brother's. Can she adopt this baby out without my brother's consent? What rights does he have? Like I mentioned before can I fight for him, even though I reside in Texas.

Does my brother have to get a lawyer to prove his dna is indeed the father of the baby? Any help or good advice is appreciated. My brother is strapped for finances right now. Was injured on the job and has been without work going through surgeries but needs to do something with the welfare of his child.

She didn't adop the boy without consent. YOUR BROTHER was sleeping with a married woman. HER husband is the legal father of the child. Your brother could clean up his act and file to establish paternity. YOU cannot do anything for him unless you are an attorney. Your brother apparently is not too injured if he could commit adultery.
