I have been thinking about something and wanted to get some opinions on it.

In the original petition for paternity filed with the courts, it states something to the effect of scheduled visitation on Sat. and Sun. of each week i believe or close to it.

Since i have found out about the abuse to my oldest daughter, should i have my attorney refile another petition asking for supervised visitation if he is convicted or is it automatically done?

If i do need to file a new paternity petition, I would probably have to wait and see what happens at the trial and go from there, right?

= You can't have an attorney 'refile' a petition, rather he can file a new motion - but you will have to prove the allegations ... Is Child Protective services involved? Have you contacted the police when she returns with bruises? If it is molestation, you can request a referal from the Police for a "S.A.R.T." test (Sexual Abuse Response Team Test) This will determine if she has been molested.

After you have your evidenceagainst him, then you can file a motion, if it molestation, the SART team should contact the District Attorney's office and they will file their own charges against him....

= not sure what you are refering to here... if you are presently in court - have your attorney file the correct papers with the court - this will get the necessary information in front of a Judge.

Paternity should have been established during begining of hearings.
