I need a link for how paternity is established. A Radio guy gave some bad advice to a listener and I’d like to give him the right info. He laughed at the fact that the unmarried father has no rights to baby until it is born and said the caller was just a bitter man. He would probably then correct himself and give the correct advise. Or let me know if I’m wrong but I thought that paternity had to be established at the hospitable after birth or with a paternity test.:D

If a dad wants to get his paternal rights he must file a paternity suit in the court. If he wants a DNA test to prove he is the father first he can ask for that first and than go from there. If he knows he is the father than all he will need to do is file to establish that he is fact the father of the child, ask for joint legal custody, get visitation set up, and child support set up. It isn't something that can be done overnight.

My case took almost a full year from the time my sons father acknowledged paternity and asked for his rights in court. It can take shorter time if no one is contesting any issues or paternity.

I would talk to a lawyer to get you started.

breif summary.

The story went something like this. Girl 16 is pregnant from Boy 19. Girl's parents are going to move her out of state and help her with baby, but keep boy away. Girl is not fighting her parents. Someone said that the boy had no rights until paternity was established and that couldn't be done until after baby was born. Girl would be move and gone by then. That statement was laughed at. Can he establish paternity any other way, to keep her from going.

nope. The girl is a minor and if her parents are moving she moves and so does the baby if she is pregnant. If the baby is already born, then the boy can petition for paternity and custody and prevent the child from moving. But he can't do anything until after the baby is born.
