Paternity Testing Question

What is the name of your state? Michigan

Scenario: Young man & woman living together for three years, have never married. They have a 2 year old child. Father is on birth certificate, child was given father's last name. Father now also wants a legal official paternity test done. Willing to pay for it out of pocket. He wants to know...can 'he' take the child to have a paternity test done without the written consent of the mother, or, would the facility doing the testing 'require' the mother to also sign something before the facility will do the test? Does she 'have' to even know about it? Thank you.

If he wants it to be "legal" and "official" then it needs to be court ordered, so yes, mom would have to know.

If he just wants to know for sure whether or not the child is his...then he can go the route you are suggesting....but its likely that if the child is NOT his, that he would still have to go the court ordered route and do it again.

He is absolutely convinced that the child is indeed his, but just wants the added verification, along with his name which appears on the birth certificate, and the child bearing his last name. I guess you would call it an added protective measure for himself?

So...are you saying...if at some point unmarried dad & mom end up in court over custody/visitation, that yet 'another' test of paternity would be ordered by 'the court', regardless? Or would the one the father obtained himself be enough for the court?

And...just to make sure I am understanding you correctly then...father can go do the testing with he and baby, and the facility doing the test would require no knowledge/signature by/from the mother?

Before I pass along this information, I'm just wanting to be absolutely certain that I'm understanding the facts 100% straight. Again, thank you.

Yes, I am saying that if they ever ended up in court, and the issue of paternity arose, that another test would be required by the court.

Since I am aware of many fathers who have quietly done paternity tests, without the mother's knowledge, then yes, I am saying that he doesn't need mom's consent to do it. He doesn't even need to go to a facility. There are kits that can be ordered online and then mailed to the respective facility.
