What is the name of your state? West Virginia

On July 12, 2004 I was terminated from my position with a Mid-Sized Wireless Provider, upon my termination I received my regular wages and fringe benefits within the legally alotted 72-Hours. However, I did not receive my June Commission Check until 2 Weeks later and my July Commission Check until 42 Days Later. I contact my previous employer on the 40th day and told them that I was contacting the DOL, I promptly received my check 2 days later. I contacted the DOL and they said that they were unable to take my case because the Company did eventually pay me my earned commission, however they did send me a copy of the state laws, stating the actions that can be taken if an employer fails to abide. By law I am entitled to a days salary for each day my employer held my wages, this totaled $3,100. I wrote a letter to my employer stating my complaint and giving them 30 days to resolve before I went to file in court (Sent Certified Mail). I did not receive any response from them and now the 30 days has expired; expired on Sept. 26, 2004. Now I must file a claim in Magistrate Court (Small Claims), however I am afraid that this company will bring in their Big Attorney's to bury me in Court. I do not know whether to hire an atty or just go it alone, any advice on the situation as a whole would be much appreciated. Thanks

Oh, Well thanks but I was hired two days after I was Terminated. Just the fact that companies get away with things like this just leaves a bad taste in my mouth. I guess I'll just seek Legal Counsel, thanks though!

You got the $$ you earned. Leave it alone. Persuing it because you can is just greedy. But if you want to persue legal counsel, go for it. Spend tons of money to never see money you didn't earn. Have fun! :rolleyes:
