The Settlement Class Members will not have to prove that their Pella ProLine Casement Windows have a “defect”in the aluminum cladding of the window and the window Sash at the corner joint of the cladding or at the glazing/Sash interface, but the Settlement Class Member still has the burden of proving that the “defect”caused the damages for which he/she is seeking compensation in arbitration.
