What is the name of your state (only U.S. law)? GA
My husband's employer for the second year in a row is giving him negative reviews because he is using sick time. After so many negative reviews than can fire you so my question is, is this legal? Can he be fired for using a benefit the employer gives him??

They can certainly give him a negative review for his poor attendance, even if they pay him for it.

Why is he using his sick time up?

Unless the absences fall under FMLA, absolutely he can be fired for excessive use of sick time.

If he is fired, he can file for unemployment ins. which he "might" get - it would
be the state's decision whether to grant UI benefits or not.

Yes and yes. Apparently your husband's employer feels that he is excessively absent. The fact that his employer provides a paid sick time benefit doesn't matter. Paid sick time doesn't provide an entitlement to be absent.
