Pending lawsuit that was not disclosed to buyer

I was in the process of purchasing a condo and had an appraisal and inspection done that was ordered by the bank. About a week before closing we found out the association is in a lawsuit against the development. If we knew this beforehand we would have never considered the property and we have since not continued with purchasing this condo due to a high rise in association dues that will happen in the future. Who is at fault for not catching this? The condo, bank, or real estate agent? Again, this information was NEVER disclosed to us until it was to late.

**A: why did you not request and review the HOA docs including Board meeting minutes, property management company records, current title report etc.? A lawsuit would have been discussed by the Board, mgt. co. and shown up on the title report as a notice of pendency.
