Perfume in Schools

I am doing a research paper about perfumes in schools. I was wondering the laws behind it, and possibly some of your opinions about it.

You've lost me. Laws about perfume in schools? Opinions thereof?

The only significance that comes to mind, would be with reference to allergic disorders and the right of one person to wear perfume vs. the right of another person to breath. Is that what you're referring to? And if so, be advised that this is a board dedicated to employment law, so any opinions you get with have that basis.

And if that is not what you're talking about, PLEASE clarify.
 
As a student, schools are my place of employment, hence the placement. I wanted to know your stand on the issue. Do you think that there should be a law against people spraying or carrying perfumes in schools?

If you intend that as a yes-or-no question, then no, I don't think there should be such a law. However, I think that IF someone has an allergy to perfume, then their right to breath takes precedence over someone else's right to spray perfume. If you want to get into a discussion about the Americans with Disabilities Act and how perfume allergies fit into it, let me know, but set aside several hours as you'll likely get more than you bargained for.

I am not an attorney; I am an HR consultant/manager. My opinion and a dollar will get you a cup of coffee.

There is presently (to my knowledge) no such law anywhere. This is a local school board issue.

No, because that's just a very short step away from legislating what kind of hairstyles people can have, what kind of clothes they must wear, what they can read, and so on.

What I DO think is:

(a) people of both genders need to use common sense and good judgement as to when it's appropriate to wear scent and when it's not;
(b) nobody should ever take a bath in the stuff;
(c) if a co-worker or fellow student finds the scent is overpowering and/or it causes them a problem of some sort, they should courteously mention that to the wearer who should just as courteously thank then for informing them and immediately cease wearing the objectionable cologne in that venue;
(d) if scent causes someone genuine health problems (asthma, migrane headaches) and the co-worker or student refuses to refrain from wearing the scent, then the employer or school needs to get involved and possibly mandate that the scent not be worn as a reasonable accoommodation to the co-worker or student with a problem.

earthgirl, I'm not sure your paper is going to have a lot of substance to it. Other than the ADA angle (which isn't all that much), the rest of your paper will be no more than random opinions on the topic.

If you are for banning perfume in school, then I would hope you are as equally for banning: people who don't regularly bathe; people with bad breath; people with crotchrot; and anyone with a particularly egregious case of vaginitis.
 
I am doing the paper on both sides of the issue and the effects that perfume has on the body. My stand is that perfume shouldn't be sprayed or carried in school. I don't really care if they wear it. I just want some more views other that my classmates'.

This is not really an appropriate forum for your purpose. As pointed out, this is for employment issues and you are not employed by the school. There is an education forum - you should try posting there and see what responses you get.

True, cbg. This has nothing to do with employment law but I'm not getting her position on this: My stand is that perfume shouldn't be sprayed or carried in school. I don't really care if they wear it. You can wear cologne to school; you just can't have it in your purse or backpack? Huh?
 
Perfume is the most dangerous to people sensitive to it right after spraying. If people have it in their backpack, then 1) they're probably going to spray it 2) if it breaks, its even worse then spraying it

AZ: I just stumbled onto your question so I may be out of place, but... As one who is sensitive to different chemical smells perfume and colone in particular, I still side with the common sense approach. Don't bathe in the stuff, and if you are approached about your "scent" bothering someone be reasonable. I no of no laws that regulate this and honestly don't want to see any. Aren't there enough already?
 
My problem is just hoping someone won't bathe in perfume, is based on the hope that that person cares about another person's health. The fact is that most high schoolers don't care about someone else, especially their health.
