What is the name of your state (only U.S. law)? CT
My sister petitioned for my parents to become legal immigrants. The petition has been approved however because of the harsh winters and their advanced age (in their 70s), my sister is considering it may be actually be better for my parents to stay in our home country (Philippines). They have their lives established in the Philippines--- friends, family, property, their doctors and church---hence it may be difficult for them to adjust to a new life when they come in the U.S.
My parents would definitely want to spend time with their grandchild in the U.S. as they so desire but perhaps no more than 6 months each time. In the process, they are able to spend time with other family in the Philippines and conveniently enjoy where the weather is best during the year (e.g. May to October in CT then November to April in the Philippines).
Question:
1. Will it be enough for my parents to keep a tourist visa to pursue this kind of travel arrangement?
2. Can they still renew their tourist visas (expiring 2011) after my sister has filed and received approval of their immigrant visas at this point? (They are due for NVC processing).
3. If my parents will opt to become legal permanent residents, will they be allowed to petition other family members over 21 even if they do not have income? How long will it take before my parents can petition any one of their children?
For the last question, I am thinking about my younger brother who expressed deside to live and work the U.S. in time.
