Hello everyone. My Daughter attends a daycare. This daycare has had some problems but nothing has ever been confirmed their wrong doing.

My wife is employeed at this daycare so this is how I found this information out.


Earlier today, someone from family and children services (im assuming) called the owner of the daycare and wanted every bit of information on 2 children attending that daycare. One of them is my 4 year old daughter. I found out about this and I was MAD! I called this lady and didn't get nothing but a voice mail (I did leave a message)

Shouldn't I personally have to consent for the daycare to release that information to anyone? Thats personal stuff like name, birthdate, ss number, address and everything! I know there MUST be a law protecting stuff such as this.

I have instructed the daycare not to release ANY information without my concent. The daycare said they would not send them anything until they have heard from me personally.

If there is, could you tell me what the law is? Thank you...

If the law in GA is similar to what it is here, their license may include a provision that they acknowledge they are required to release that information to law enforcement or other investigative agencies upon request. It is very likely that the daycare has no legal right to withhold that information even if you wanted them to.

I would be very surprised if there is a law that does NOT require them to release the information to the appropriate investigative authority.

I mean, I dont mistreat my children or anything. I just find it strange that they only want reports on 2 children. I got nothing to hide but I dont like stuff being done without my knowledge like that.
 
Before you hand over information make sure you know who you are giving this information to. Don't just accept a card from them, if they work for DFCS they should have a badge. You have the right to ask for laws that give them the authority to request and seize personal information. Child Protective Services like to recite administrative policy as though it is law and confuse people, policy is not the law. I was a caseworker for Dekalb DFCS in GA and CPS do ask for things that they are not entitled to. I've seen workers ask medical professionals for medical records without having a release of information from the parents. Thanks to HIPPA the Dr's knew to request a release of information from the worker and if they don't get a release from the parent the worker has to get a warrant and they wont go that far. My guess is they are looking for residential information. If it's an eligibility worker (one who determines eligibility for public assistance)they are being sneaky and asking for the information because they want to know if the children's father is listed as a person who can pick the kids up and this is a way for the worker to deny public assistance. Using the fact that the mother is obviously living w/the father or something of that nature. If this is the case and you dont comply they wont do much, they're to busy.

If the child is a victim of a crime, it is very likely that no warrant or release is necessary to receive that information - especially in a case where the parents might be suspects.

State laws vary on the matter.

If a child is a victim of a crime than there will be NO problem on getting a warrant from a judge. Knowing DFCS in GA like I do, I would bet this is not CPS and a worker looking for information on the AP.
