I wsa admitted to the US for a 6 month stay, that was 18 months ago, am South American, have recently married a Cuban citizen who is a legal resident with a resident visa, He has received a letter fron INS approving his application for citizenship, he will be contacted for the date of his exam and future swearing his citizenship( it could take between 2 months to a year to obtain)
We wanted to file a petition under the Cuban adjustment act, to legalize my status in the US, some friends say that we should wait for his citizenship papers. We do not want to waste time and want to go ahead and file my Adjustment of status, will my papers or procedure be delayed or denied if by the time of the final interview( which should be in no less than 9 months)he is already an American Citizen????
please advice me

I do not know the exact wording of the CAA so can not help you... but it is always better to deal with the INS when you have a US citizen behind you. If you apply now, they might arrest you and throw you out of the country.

My advice is to call an immigration attorney in your area who knows the CAA.
