Our family photographer is contracted with a national baby clothing company. She has taken a dozen of my child's photos, and asked if we would be interested in my son modeling for this company. We verbally agreed to take some pictures to send ot them. The company loved my son, used his picture on their catalog, their website, and has a HUGE picture of him in New York City at a store on 5th Ave. We never physically signed anything stating the release of our child's photos to this company's use. I understand the photographer has the copyright on the pictures, but do we have any say in teh use of our son's pictures? Shouldn't we have signed something? Not to mention the money the company and our photographer gets out of the deal.
Do we have any legal action, or steps we can take?
