My neighbor has harrassed me over 2 years and I'm done. My attorney sent them & their landlord letters a few days ago and now they are even worse. The landlord has 15 days to respond before suit and seeking a adjunction. I own mine, they rent and they have caused havoc all over in our condo complex but they HOA just sits on it because they don't want to run up legal bills. (the owner is trying to say we are discriminating because they are able to rent) I left the HOA out of the complaint so far but I'm starting to rethink that maybe I should go after them for lack of enforcement, their comment so far was the bylaws are just papers, unenforcable. My attorney said they are wrong and the first thing the police ask is what's the HOA say? I've documented (pictures, dates, times) for the last 2 years all the crap so I really have nothing to lose (except $$$) and I figure why not run their bills up too! Anybody ever sue and win?
