What is the name of your state (only U.S. law)? MA

My son was in a mall and decided to play an arcade type game that was outside a store. It had a sign that said it was $1 to play. It had a card reader, so my son put in his debit card. Instead of charging $1, it deducted $5 and he received five plays. He really only wanted one.

He was mentioning this to me in the presence of a store clerk who pointed out the ways in which this machine is unbeatable.

I gave the machine a closer look and thought just maybe she was right. I can't imagine the prizes (Ipads) surviving a 30 inch drop into the prize chute. She also stated she walks by this machine every day and the number of prizes displayed never changes.

At any rate, it had no town license sticker on it.

We're considering this a $5 lesson learned, but it is making for a lively conversation at our house and you are welcome to add your insights.What is the name of your state (only U.S. law)?

You can call the town and rat them out for not having the appropriate sticker on the machine. That will not benefit you financially.

You can sue them for breach of contract. In order to do that, you will need to hire an expert witness to testify that it is not possible to win, and therefore they breached the contract you had. If you win, you should get your $5 back.

It would be foolish to sue.

This is a mid sized mall that was built in a small town. I spoke to the town administrator and she was genuinely interested. Apparently this machine was not properly licensed.
