What is the name of your state? ca...Ok here's the story. I recently contacted the child support dept to find out if there was any money owed to me because my mother is now deceased and I have no idea if any money was ever collected. They asked me to send in my id and social security # and some other info. Just recently I talked to the worker on my case and she said she would have to speak with a lawyer and she had no idea how long this was going to take and she was very rude. Then they said they would not be able to release any info until they find out how much is actually owed to my mother.

Then I wrote her supervisor and said she had no info for me when she finally called me back and all I want are the basics. I want to know if there was any money that was owed to my mother where would it go? There is no statue of limations in cali. I am 26 and I was told I should really pursue this but now I don't even know. They recently just wrote me asking for my mother and fathers divorce papers which I have. So I just sent them off today. Is this a big waste of time?

Just to let you know there was a support case open in 79 when my parents divorced it said 100.00 a month until I get married, am deceased or until I turn 21.

Any ability to collect is subject to several factors.

Do a search under "Laches". There are prior posts in which this has been discussed extensively. If your mother took little to no action to collect in recent years, the obligor may be able to use such a defense.

Additionally, if the NCP has no assets, and is not working, there may be no collection measures you can take to collect. For example, if he's on disability and has no assets to seize, you may have a hard time. Do you even know if he is alive? There are collection measures out there, but they aren't always applicable. Also, I'm not sure how much assistance the CS office of his state of residence will provide for a case of this age.

He is still alive. And I listened to the automated system to find out if any payments were posted lately and he has been making a payment almost every friday. And my point is where is that money going?

OH. This is not a "collection" issue. It is a disbursement issue. Whomever has the legal authority to act on behalf of her estate should contact the CSE office and find out.

well if your mom was like getting cash payments from welfare, welfare is more likely to keep the monies from child support to remiburse back into the system. I know one woman who was on welfare, getting cash payments from welfare and NCP had to pay 100 dollars per month and this woman gets to get 50 dollars and welfare keeps the rest...but if NCP gets into arrears, then this woman does not get any cent from him at all and when back child support came up, welfare kept every cent of it and gave nothing to her. but if the payments were current, the woman gets 50 dollars out of it.

Maybe if you should talk to welfare office and ask them to look at the records I am not sure if it is confidentional or not altho.
you say that your dad had been making payments everyFriday, obviously it goes to welfare???????? I might be wrong.....talk to someone else.
