What is the name of your state? CA
Ok...I live in CA..I gave my 2 weeks notice. I also called in sick my last day of work..Oops! But I was REALLY sick. Sunday August 8th..Honest...I dont know if that makes a difference BUT anyway.
I went int the following Friday which was payday to get my check. It wasnt there. They told me that Id have to come back the next day to get it. I called the next day and they said they had sent it to me by mail...Well that was on August 13th..Fine. I was alright with that. A week went by and I still didnt receive it. They again said it was sent and by mail and that the 'Company' in question sends it by mail. Well I called in the week before labor day to still the run around. I spoke to the payroll lady and she said that if I didnt get it by that next Wed to come in and they'd send me another one. So I filed a claim.
My check says it was written out August 15th...But the postage on the envelope says it was paid September 1st. And my check wasnt printed by Computer it was hand written..I didnt receive my check until September 10th...When I filed my claim I did it because these bosses had always been mean to me while I was employed. I was tired of their games. I filed honestly not to be greedy but because I felt bullied. Now that I recieved my check I feel bad about the claim..BUT the papers just came stating the date I must attend a hearing. Should I go? Should I pursue? Should I withdraw the claim? How? Can I get in trouble??
Also I got more money on my check than I claimed, I also wast exactly 100% on my claimed figure amount by hours can I get in trouble...I was only off a couple hours. I was over hours claimed by like 2 hours BUT actually under my claim amount by about $30.00...What can I do..WHAT should I do?

Should I go? Should I pursue? Should I withdraw the claim? How? That's all up to you. If you wish to withdraw your claim, I'd expect you can do so.

Can I get in trouble?? For withdrawing your claim? No.

That's confusing as heck. Are you saying your employer overpaid you? If so, you should call them and staighten that out as eventually they will discover their error and will come looking for repayment.

If you're satisfied with the status of the situation, you are free to contact the State and tell them you received your final check and no longer wish to pursue this. As to whether your employer actually dragged their feet, that's impossible to say. I can tell you that several years ago I received a resume from a job candidate via U.S. mail that was delivered a YEAR after it was postmarked. Who knows where it was all that time????
