What is the name of your state? Massachusetts
I am so confused when it comes to my marriage. I'm divorcing my husband cause of the way that he's treated me over the 7 years that we've been married. We have three children together and that's the only good thing that ever came from our marriage. I filed for a restraining order a few months back because he threatened to hurt me. I'm aware that there's no such thing as a "legal separation" in the state of Massachusetts, but I've also read that once you're living apart from eachother you are considered to be legally separated. Is this true? I need to know cause I've been seeing someone and I am now 6 weeks pregnant w/ his child. I don't believe in abortions unless there's a medical reason, so that's out of the question. If I put the paper work in for a divorce and it's done before anyone ever notices my pregnancy could I or the father of the baby ever be convicted of adultry? If so, would we likely be facing imprisonment or a fine of, I believe... $500? Would my husband even be able to attempt to hold that against me after a divorce is final? Could he ever win that after what he's done to me? There's even a charge on his criminal record from 2001, he was arrested for putting his hands on me. I'm just scared that the courts would still look at it as adultry cause we were still legally married when this child was conceived. Can you please help me? I need to know my rights so that I can relax. I can't wait to finally be divorced and be happy for the first time in years. I know you might be thinking....why didn't I just leave him a long time ago? I had kids and I was scared to be alone. Now I'm afraid that one of us could end up in prison. I mean, I could understand if I was happily married and just cheated on him. But that's not the case at all. This divorce should've happened so long ago. Does it help that I got the restraining order and left him before the baby was conceived? I was not w/ him when I started seeing this other man.
