I was married to my first wife and had 2 children with her. We were divorced 4 years ago. We were both addicted to drugs. I let my father and stepmother have temporary parental custody so I could go to rehab and get my life together. My ex, the kid's mother has had basically no contact with the kids since. I successfully completed rehab and have been clean since then. I paid my child support and visited the kids every few months. I talked with them on the phone and Skype regularly. I sent them letters and cards regularly. In 2011 I got remarried and we moved to Florida. We just could not make ends meet there. We moved to Florida, got jobs, a nice vehicle, and a 4 bedroom house. I was trying to do what I had to do to get my kids back. We went back to TN in March and spent 6 days with them. I have been paying my child support regularly and calling. I found out that my ex wife had a job finally so I called my father last night to tell him so they could get her for child support too. My father told me that it didn't matter because her parental rights had been terminated and so had his. He said that they have already adopted the kids. I don't understand how this can happen. From what I have read I am suppose to be notified and served. They said they posted it in THEIR local paper. Again, from what I have read the only way they can do it that way is if they do not know where I am. My father has my phone number, my address, and he talks to my family in TN on regular basis. I have lived at the same address for a year now. TN child support has all of my info too. My ex (the mother) who has had almost no contact with them and no one knew exactly where she was got served. They knew that my ex would not contest it so she got served. They knew that I would contest it so they lied to the court and said they had no idea where I was. I need help and advice really bad. Please, my whole world has been taken from me.

So, you saw the kids "every few months" and you thought that was sufficient?:confused::rolleyes:

Your children needed parents. If they used legal means to obtain that end then there is not much you can do other than to stop sending child support for the children you no longer have.

I did the right thing by letting my father have my kids temporarily instead of letting them go to foster care. It is kind of hard to work a full time job, pay my child support, maintain a home and be able to travel from state to state to visit constantly. I was doing what I had to do to get a home and life built to get my kids back. And no they did not do it legally. I was suppose to be notified of this and have the chance to contest it.

It's time for you to answer the question that's been sitting around for FOUR YEARS: what's in the best interest of those children?

You need to contact the court which allegedly terminated your rights and ask for a copy of the file (it will cost you money). You will need to see if your rights were terminated and your father actually adopted. If he did, then you will need to get an attorney who might be able to get it overturned due to lack of service OR other procedural issues.

Actually that is NOT the question that needs answered. What needs answered is whether everything was done correctly and his rights were safeguarded.
