I posated here back in May regarding a breach of K suit I filed for work not done, merchandise accepted but no payment, no return of merchandise. Small claims filed 5/18. Thinking about this, I also realized he told me he was a contractor (was not), had no clue what he was doing..now I am paying. I did not include these claims in my small claims suit but I belive he is also liable for negligent misrepresentation (unskilled enough and no resources to perform work) and possibly fraud. Should I amend my small claims complaint, do I have to withdraw and refile. If I bring it up in court as is, only the breach of K claims, since I did not include these new charges, will the judge even hear it? - I found out additional info after I filed the suit.
WHat's the best course to get this guy all he deserves...

Amend the complaint now. The judge will not let you add them once you arrive. And once the 1st case is over, you will be legally precluded from bringing a 2nd case covering the extra claims.
