I am losing my sleep over this. I would appreciate your input on this issue.I have my I -140 approved. About 2 years back I had a citation for offence 532(A) (Theft/fraud charges)in 1998. I pleaded guilty in court and the case was dismissed.

I want to go the Consular processing way as opposed to I485. My 2 questions are:

1. Since I pleaded guilty at the time, what should my answer to the question number 28(b) of the form OF230 (part II) be? I.e., The question asking for a yes or no on - An alien convicted of, or who admits having committed a crime involving moral turpitude or………

2. Am I taking a big risk here/ Can they reject my Green card for this reason alone? What r my safer options?

Define 'dismissed' You pleaded guilty but they then dismissed the whole case ??

Yes!the judge was kind enough to give me some classes to do and pass a non-conviction judgement.

It is unlikely this would stop them issuing a green card.. but be honest.. always ! cos if you lie they will throw your butt out. If you have to, write the information on a seperate piece of paper and attach it to the form.

Both Theft and Fraud are CMT. So you need to put yes.. but attach a seperate sheet to explain the sentence etc..
