My brother in law's wife left him and their daughter. She messed around for 2 weeks and kept telling him she was planning on coming back(which was a lie). It has done major emotional damage to my neice. She has now filed for a divorce. He is trying for custody of my niece who is in his care right now. She has had 2 other children taken away from her in another state from previous marriages and a third child to whom she relinquished parental rights to. Could this fact be used against her in the custody hearing? Also, they live in my house so i have seen with my own eyes things that i think would prove a case against her. Would a sworn affadavit be admissable in court or would i have to testify. Things like:locking the child in a room for long periods of time so she could sleep, spanking the child for no reason and with excessive force, not feeding the child on a regular basis, when the child was a baby--she would let her sit in soiled and wet diapers in the crib--when i saw her she was so soaked in her own urine her hair was wet from it. I have also seen bruises on the child which she gave explanations for but i never really beleived her because the injury didnt match the explanation---what should my brother in law do in this case
As far as where he was when all this"abuse" was happening to my niece--he was at work--he tried to deal with it--but my sister in law wouldnt listen. She currently has a DFACS case on her(not the father, just her). Would that affect anything.

good---cause he was told by someone that her past didnt matter--he is so stressed out by all this it is pitiful--he dont want to lose his baby.==thanks for the advice
