My aunt has POA's over my grandparents (I believe there are three, one for medical, one for business and one for something else). There are several problems with this...I believe that she is paying her bills from their account. My grandmother passed away a couple of weeks ago and my grandfather is clueless about their finances. There are a couple of things I want to know...
1. How do I obtain copies of those POA's...she isn't going to give them to me and my grandfather doesn't have a copy at his house.
2. How do I obtain a copy of the will...she isn't going to give this to me either.
3. We went to see an attorney (who supposedly drew up their wills) a week ago and he didn't have a copy of the will, nor did my aunt bring a copy with her.
4. I think the will specifically states that some of us grandkids are supposed to get certain things of my grandmothers in case of her death. The problem here is we don't want anything until my grandfather gives it to us or passes away....these are truly his belongings and should hold on to them to remember her by. However, my aunt has already started taking things out of his house without his knowledge.
5. Last but not least...on the day my grandmother passed, my aunt went to the local pharmacy and picked up a prescription for my grandmother (vicodin) after I had already notified the pharmacy of her death. My aunt used the old "POA" card on the pharmacist (who didn't want to get in the middle of it).
I would consider this abusing her POA status as well as violating her fiduciary responsibility to my grandfather? I want my grandfather to revoke her POA and reassign it to me (my dad is in agreement)...but how do I go about doing that?
