Police unfairness

The police were called on my daughter for throwing a fountain drink at my 20 year old neighbor. The policeman wouldn't hear our side of the story. We asked him if we could talk to another officer, and he said that there won't be another one on duty for another 12 hours! We live in a city of 30,000 and know there are others on duty! If we don't like how the officer is handling the situation then don't we have the right to ask for a different one? We've had problems with this one before. Theres alot more to this story.

WHY did you erase and ignore our initial and MANDATORY requirement?

On another note, your kid cant go around throwing drinks at people, and I'm sure another officer would have handled the situation the same. Who cares about your side of the story, throwing things at people is ASSAULT.

MAYBE if your family were better law abiding citizens, you wouldn't have had other incidences with this officer, who MUST be tired of seeing you guys like every day.

What do you think another officer would be less likely to find your daughter assaulted the neighbor, and should be arrested?

No.

Be a better parent and stop trying to lay the blame outside of the real problem.

You have the right to file a complaint regarding the conduct of the officer.

If charged, your daughter has all the rights guaranteed to those accused of a crime.

You do not have a right to demand that a police report be written the way you want it to be and you do not have the right to demand that another officer be dispatched to get the side of your soda-throwing embarrassment of a daughter.

Hey, you even had the right to ask for another fountain drink, :p
But again, the officer doesn't have to comply in your case.

And her side of the story would have been a lawful justification for assault ... why? Was it self defense? Was she herself being assaulted by the neighbor?

Even if he called her a nasty name, that would not be a legal justification for assault ... it might be understandable, but not a legal justification.

First off, you do not have a right to have another officer. You get what you get. And while there may have been other officers on duty, there may not be another officer assigned to that beat for 12 hours. They are under no obligation to pull an officer from elsewhere in town to come and serve you because you do not like the officer that got dispatched.

You can ASK for most anything, but the city is under no legal obligation to provide you with another officer.

Then call the agency and ask to make a complaint about the conduct of the officer.

But, even if the officer was rude or did not care to listen, how would it have changed the facts of the matter at hand? If your daughter is charged with a crime she will have an opportunity at trial to testify as to her legal justification for the assault (and battery if it hit the neighbor). Of course, it is doubtful her attorney would allow her to take the stand and confess like that unless there WAS a self defense justification. If there are no pending charges, then it is done with anyway.

If you've had problems with that officer before, it indicates that your daughter is a habitual troublemaker.

Please. Don't bring her to the U.S. We have more than enough punks here without having to deal with yours.

It is funny that everyone reacted this way because although I agree she did assault the neighbor I have a similar story where an off duty cop was drunk in my restaurant (in a casino) and when the state police came they told the woman who they threw ketchup on to go wash her clothes because there was nothing they can do....funny that cops can get away with throwing ketchup but a 12yr old girl committed assault by throwing water

It was soda, not water.

No where was the age of the daughter mentioned.

We (or you) weren't there at either incident. Maybe there was a key difference.

I'm guessing the OP (moodygw1) signed up again under a new name (megbarr7) to share her little unrelated anecdote, letting slip additional information (i.e., daughter is only 12) that was not in her first post.

Ya I was half asleep and didn't pay attention...I actually just found that post looking for something like what happened at my job because i was really shocked...I do think even if it was water you can't just go around throwing anything on or at anyone without consequences and I don't know where I got 12...but there were cops who threw ketchup at other customers in my work place and I know the whole story and it was not right, I am making a complaint on the officers that responded but I just thought it was funny that it is considered assault unless it is one of them
