What is the name of your state? Oklahoma

My husband is currently en route to hopefully pick up his daughter. He was supposed to pick her up from school this afternoon, but the cp called about an hour before he was supposed to be there to tell him that she wasn't there and that they have moved to another city. The cp will not give my husband her new address. She told him he could pick her up from this certain place in the new city if he is there by 7pm. We are praying that she is really there whenever he gets there. She did not notify my husband of this move and this is the second move in 5 months. My dh is afraid that if he gives her back next week when he is supposed to return her for the second week of Christmas break that he won't see her again after that and we will have no way to find her. Is there anything my dh can do? Is this grounds for an emergency custody order. The cp is firm on the fact that she is not giving him her new address.

I hope she's there when he gets there. :(
 


So the possibility of abduction and the fact that the child has been moved to an undisclosed location is not grounds for emergency temporary custody at least until cp provides that info?

Does the divorce decree state that she is required to inform him of her address at all times? Do you want to be punished for something that you "might" do?
 
It is required in Oklahoma law. CP's are required to give 60 days notice of relocation and provide an address where they are moving. The NCP's have 30 days to dispute the relocation.
 
Yes, of course. He's just upset because this is the 3rd move in a year (the second move within the last four months.) His daughter is going to yet ANOTHER school and he has no idea where his daughter lives, what kind of an environment it is, etc.
 
How old is your stepdaughter? She has not clue of her new street address or the name of the school?

Will she be with you for at least a week? I would file for an emergency hearing and inform the judge of this being a pattern.

The odds of getting an emergency hearing within a week are not very strong right now....not for this particular week. Almost any other week of the year probably wouldn't be a problem, but this one is.
 
I figured as much. My stepdaughter is six years old. We have asked her what school she is going to and she says she doesn't know yet. She hasn't started. Her mom just apparently pulled her out yesterday and she hasn't started school yet since it is Christmas Break. She doesn't know where she lives, because her mom doesn't teach her that kind of stuff. She can't even tie her own shoes, even though we try to work with her, but we don't get enough time with her to work with her.

Mom has threatened before never to allow my dh to see his daughter again. She is really flaky when it comes to this stuff. She showed up at the beginning of Thanksgiving Break and told us that we had to keep my stepdaughter (even though she was supposed to have that holiday.) We had plans to go out of town that we had to change because she told him that if he didn't take her he would never see her again.

Everything with her is a roller coaster. One minute she is really nice and practically falling over herself to give my dh extra visitation and then the next she could go completely crazy telling him he can't see her. That's why he's so concerned about not having an address because then he is pretty much at her mercy.
